Welcome to Refined Spaces ("Company", "we", "us", "our"). These Terms of Service ("Terms") govern the relationship between Refined Spaces, led by founder Bradley Francis, and our clients ("Client", "you", "your") for all painting, decorating, tiling, kitchen and bathroom refitting, and high-end refurbishment services across the Isle of Wight and surrounding South Coast regions.

By commissioning our services, signing a project proposal, or permitting work to begin, you agree to be bound by these Terms.

Scope of Work and Variations

• Specifications: Refined Spaces will execute the project in accordance with the signed itemised proposal and finalised specifications.

• Client Variations: Any changes, additions, or design modifications requested by the Client after the contract is signed will be treated as a "Variation". Variations must be agreed upon in writing and will incur additional material and labour costs, which will be billed accordingly.

• Unforeseen Structural Conditions: Our proposals assume structurally sound existing substrates and walls. If our team encounters hidden defects such as blown plaster, structural damp, rotted timber joists, asbestos, or unsafe electrical and plumbing systems that were not reasonably visible during the initial site survey, any necessary remedial work will constitute a variation and incur additional charges.

Payment Terms and Title of Goods

• Deposit: A non-refundable deposit (specified in your proposal) is required to secure your project slot on our schedule and initiate material sourcing.

• Stage Payments: For larger or multi-week refurbishments, a schedule of interim stage payments will be outlined in the contract and must be settled promptly at each milestone.

• Final Payment: The remaining balance is due immediately upon practical completion of the project.

• Retention of Title: All materials, paints, wallpapers, tiles, kitchen units, sanitaryware, and structural goods delivered to the site remain the sole legal property of Refined Spaces until the final project invoice is paid in full.

Limited 3-Month Warranty and Exclusions

• Warranty Availability: Refined Spaces takes immense pride in our craftsmanship. A limited three-month warranty is available on select installations, including paint adhesion, woodwork structural stability, and tile fittings, from the date of practical completion.

• Service Exceptions: Not all services or components carry a warranty. Due to variables completely beyond our control, the following exclusions apply strictly:

  • Structural Movement and Damp: We apply premium products under optimal trade conditions. However, we cannot guarantee coatings or finishes against subsequent building movement, structural settling cracks, rising damp, water ingress, or poor ventilation causing condensation and mould.

  • Client-Supplied Materials: No warranty is provided on paints, wallpapers, tiles, appliances, or fixtures purchased or supplied directly by the Client.

  • Natural Wear and Tear: The warranty does not cover normal wear and tear, accidental damage, or subsequent modifications made by the Client or third-party tradesmen after our team hands over the completed space.

Site Access and Client Responsibilities

• Access Requirements: The Client must guarantee our team clear, unobstructed access to the work areas, as well as access to clean water, toilet facilities, and electricity utilities for the duration of the project.

• Permissions and Clearances: It is the Client's sole responsibility to secure all necessary planning permissions, listed building consents, landlord approvals, and neighbour clearances prior to the start of work. Refined Spaces accepts no liability for disputes arising from unauthorised structural changes.

Liability Limits

• Refined Spaces maintains comprehensive public liability insurance.

• We accept no liability for any damage caused to hidden or undocumented pipes, cables, or utilities that were not explicitly disclosed to us or clearly mapped out on official property documentation prior to work commencing.

• Our total liability for any claim arising out of the project, whether in contract or tort, shall not exceed the total price paid by the Client for the specific service rendered.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the English courts.
